Did you know that royalties may be due when an original work of art is bought from an art market professional? Artist Resale Rights are due as a result of European legislation and apply where an art professional sells an original work for more than 1,000 euros (based on the exchange rate on the day of the sale) and where the artist is still alive or has died within the preceding 70 years. There are two main agencies that administer the scheme, but the artist does not have to be registered to a specific agency for the fee to apply. The scheme is a controversial one in many respects and views are divided as to its success, but its aim is to provide a supplementary income for artists and their families.
